The Artificier is part of AAH Services Group. All terms and conditions, along with our policies, are established in accordance with AAH Services Group’s guidelines and regulations.

These Terms and Conditions (“Terms”) outline the rules for using The Artificer’s website and purchasing their services. By using the website or buying their services, you agree to these Terms.

Client Information​

  1. Accurate Information: You must provide accurate, complete, and up-to-date information to The Artificer, including your name, contact information, and any other details relevant to the services you require. You are responsible for notifying them promptly of any changes to this information.
  2. Authorization: You represent that you have the legal authority to enter into this agreement on behalf of yourself or the organization you are representing. If you are acting on behalf of a company, you may be required to provide proof of your authorization.
  3. Payment: You agree to pay all fees associated with The Artificer’s services as outlined in their agreements and invoices. Payment terms will be specified in writing and may include upfront deposits or milestone payments depending on the project scope.

Fees and Payments

  1. Fees: The Artificer’s fees for services are listed in their proposals and agreements. These fees may cover project management, creative development, content creation, implementation, and ongoing maintenance (if applicable). Additional charges may apply for services not explicitly included in the initial agreement, such as rush orders, revisions exceeding a specified number, or additional features or functionalities.
  2. Payment Methods: You can pay for The Artificer’s services by credit card, bank transfer, or other methods agreed upon in writing.
  3. Late Payments: Late payments may incur interest charges or a suspension of services until the outstanding balance is paid in full. The specific late payment fees will be outlined in the agreement.

Service Provision

  1. Project Details: The specific deliverables, timelines, and expectations for services will be outlined in a separate project agreement or proposal. This document will detail the scope of work, including the services to be provided, the final products or outcomes, and the timeline for completion.
  2. Revisions: A reasonable number of revisions is typically included in The Artificer’s agreements, allowing you to refine the deliverables to meet your needs. The specific number of revisions included will be outlined in the project agreement. Additional revisions beyond this number may incur extra charges.
  3. Client Cooperation: Your timely feedback and cooperation are essential for the successful completion of the project. Delays caused by your failure to provide necessary information or assets, such as logos, brand guidelines, or content, may impact project timelines and deliverables. The Artificer may adjust deadlines or fees if such delays occur due to your lack of cooperation.

Intellectual Property

  1. Ownership: Upon full payment of all fees, you will own the intellectual property rights to the final deliverables created specifically for you as part of the Services. This may include ownership of things like website content, graphic design elements, or marketing copy.
  2. Portfolio Use: The Artificer reserves the right to use the final deliverables in their portfolio and marketing materials, unless otherwise agreed upon in writing. This allows them to showcase their work to potential clients. You can opt out of this by explicitly requesting it in writing.

Confidentiality

  1. Confidential Information: Both parties agree to keep confidential any proprietary information or trade secrets disclosed during the course of the project. This includes information you provide to The Artificer about your business, as well as any confidential information they may share with you about their processes or tools.

Termination

  1. Termination for Cause: Either party can terminate this agreement for cause if the other party significantly breaches these Terms and fails to remedy the breach within a reasonable period, typically 30 days written notice. A material breach could be things like failing to pay invoices, consistently missing deadlines, or delivering work that is far below the agreed-upon standards.
  2. Termination for Convenience: You can terminate this agreement at any time with written notice, subject to payment for work completed up to the termination date. The Artificer may also require you to compensate them for any out-of-pocket expenses incurred specifically for your project.

Liability

  1. Limitation of Liability: The Artificer’s liability for any damages arising from the Services is limited to the total amount you paid for the specific project or service in question. This means that their financial responsibility for any issues that may arise is capped at the amount you paid them.
  2. Indemnification: You agree to protect and hold The Artificer harmless from any claims, losses, or damages arising from your use of the Services or your breach of these Terms. This means that if your use of The Artificer’s services causes any legal or financial problems for them, you agree to take responsibility for those issues.

Governing Law

  1. Dispute Resolution: These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. This means that the laws of England and Wales will apply to any legal disputes that may arise out of or in connection with these Terms.
  2. Jurisdiction: Any legal action or proceeding arising out of or relating to these Terms and Conditions will be brought exclusively in the courts of England and Wales. This means that if a legal dispute arises, you agree that the courts of England and Wales will be the only courts with jurisdiction to hear the case.
  3. Waiver of Jury Trial: YOU AND THE ARTIFICER WAIVE THE RIGHT TO TRIAL BY JURY FOR ANY CLAIMS OR ISSUES ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS. This means that you and The Artificer both agree to give up your right to have a jury decide the outcome of any legal dispute arising from these Terms.
  4. Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. This means that if any part of these Terms is found to be invalid, the rest of the Terms will still be enforceable.
  5. Entire Agreement: These Terms and Conditions constitute the entire agreement between you and The Artificer with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. This means that these Terms are the complete agreement between you and The Artificer regarding the use of their services and website, and they supersede any other agreements or promises that may have been made beforehand.

By using The Artificer’s services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
